1. | The arrangements of liberalization of trademark agency services in Mainland China under the framework of “Mainland and Macao Closer Economic Partnership Arrangement” |
| - Introduction
The Mainland and Macao Closer Economic Partnership Arrangement (hereinafter referred to as “CEPA” in short), signed on 17th October 2003, which built up an unrestricted trading relationship, featured a new phase in history for the economic and trade interflow as well as the cooperation between the Mainland and the Macao Special Administrative Region.
CEPA is variable and liberalized. Pursuant to the provision of Article 3.2 of CEPA, “The two sides will broaden and enrich the content of the “CEPA” through continuous and further reciprocal liberalization between them.” Along with the deepening development of the economic integration between the Mainland and Macao, new consultations of the further opening of the scopes of trade in goods as well as trade in services have been initiated since July of 2004.
On 29th October of 2004, the Central People's Government and Macao SAR Government signed the text of the supplementary protocol to the “Mainland and Macao Closer Economic Partnership Arrangement”. The content of trademark agency is embodied in the annex 3 of the supplementary protocol.
To implement the corresponding spirit, the State Administration for Industry and Commerce promulgated the “Temporary Measures Concerning Trademark Agency by Service Providers from Hong Kong and Macao SAR in Mainland” (hereinafter referred to as “Temporary Measures” in short), which has come into effect since 1st January, 2005.

2. | The content of exchanges and cooperation in the area of trademarks under the framework of “Mainland and Macao Closer Economic Partnership Arrangement” |
| - Introduction
On 11th May 2009, the Central People's Government and Macao SAR Government signed the Supplement VI to the “Mainland and Macao Closer Economic Partnership Arrangement”, which has come into effect on the day of signature by the representatives of the two sides, to enhance the economic and trade exchanges and cooperation between the Mainland and Macao. The highlights of relevant Supplement are related to the following three scopes, which are: performing further liberalization of trade in services, enhancing trade and investment facilitation, and promoting mutual recognition of professional qualifications. In the aspect of enhancing trade and investment facilitation, both sides agreed to adopt further measures to intensify the exchanges and cooperation in the area of trademarks, in order to strengthen cooperation in the protection of intellectual property rights.
In respect of cooperation mechanism, the State Administration for Industry and Commerce and Macao Economic Bureau shall establish a communication mechanism in order to strengthen the cooperation of both sides in the area of Trademarks. Contents of cooperation include the followings: Strengthen exchanges of information in relation to Trademarks between the two places. Enhance the understanding of trademark registration systems of the two sides by enterprises in both places by means of seminars, discussion sessions, and website propaganda, etc, as well as strengthen cooperation of the two sides in personnel training.
